By using Sidetracked Day, you agree to these Terms.

1. About Sidetracked Day

Sidetracked Day is a hyperpersonalized study platform for university students. The Service allows users to create an account, upload PDFs, generate study plans, use AI-powered study tools, track progress, and receive personalized learner insights.

Sidetracked Day is intended for users aged 13 and older, primarily university students.

2. Accounts

You may need an account to use certain features of the Service. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

You must provide accurate information when creating your account and keep it up to date.

We may suspend or terminate accounts that violate these Terms or create risks for the Service or other users.

3. User Content

You may upload content to the Service, including PDFs and related study materials ("User Content").

You retain ownership of your User Content. However, by uploading content, you grant Sidetracked Day a limited, non-exclusive, worldwide license to host, store, process, analyze, reproduce, and use that content solely as necessary to operate, improve, and provide the Service to you.

You are responsible for your User Content and confirm that:

• you have the necessary rights or permissions to upload and use it
• it does not violate applicable law, copyright, or third-party rights
• it does not contain malware, malicious code, or harmful material

Please do not upload sensitive personal data unless it is necessary and you are legally permitted to do so.

4. AI Features

Sidetracked Day uses automated and AI-supported systems to analyze uploaded materials and generate study plans, study trainer content, and personalized learning insights.

AI-generated outputs may be incomplete, inaccurate, or not suitable for every learning context. You should use your own judgment and, where appropriate, verify important information with original course materials, instructors, or other reliable sources.

Sidetracked Day does not guarantee academic performance, grades, exam outcomes, or the completeness of generated content.

5. Acceptable Use

You agree not to:

• use the Service for unlawful, harmful, or fraudulent purposes
• upload content you do not have the right to use
• interfere with or disrupt the Service
• attempt to gain unauthorized access to the Service or related systems
• reverse engineer, scrape, copy, or exploit the Service except as permitted by law
• use the Service to generate or distribute harmful, abusive, infringing, or misleading material

We may investigate violations and take appropriate action, including suspension or termination of access.

6. Paid Features and Subscriptions

Some features of the Service may require payment or a subscription.

If you purchase a subscription through Google Play, Apple, or another app store, billing, renewals, cancellations, and certain refund matters may be handled by that platform and subject to its terms and policies.

You are responsible for reviewing the pricing, billing cycle, and renewal terms shown at the time of purchase.

If required by applicable law, mandatory consumer rights, including any applicable withdrawal rights, remain unaffected by these Terms. EU consumer law imposes specific information and withdrawal rules for online digital services.

7. Availability and Changes

We may update, improve, modify, or discontinue parts of the Service from time to time.

We do not guarantee that the Service will always be available, uninterrupted, error-free, or compatible with every device or course format.

8. Intellectual Property

The Service, including its software, branding, design, content created by Sidetracked Day, and all related intellectual property rights, belongs to Sidetracked Day or its licensors and is protected by applicable law.

Except as expressly allowed in these Terms, you may not copy, distribute, modify, sell, or create derivative works from the Service.

9. Privacy

Our processing of personal data is described in our Privacy Policy. By using the Service, you acknowledge that we may process personal data in accordance with that policy.

10. Termination

You may stop using the Service at any time.

You may delete your account in the app or request deletion of your personal data by contacting info@sidetrackedday.com, subject to any legal retention obligations.

We may suspend or terminate your access if you violate these Terms, misuse the Service, or create legal, technical, or security risks.

11. Liability

Sidetracked Day is liable without limitation in cases of intent, gross negligence, injury to life, body, or health, and where liability is mandatory under applicable law.

In cases of slight negligence, Sidetracked Day is liable only for breach of essential contractual obligations, and only for foreseeable damage typical for this type of contract.

To the extent permitted by law, any further liability is excluded.

Nothing in these Terms limits rights that cannot legally be excluded, especially under mandatory consumer protection law.

12. Third-Party Services

The Service may rely on third-party providers or integrate with third-party services. Sidetracked Day is not responsible for third-party services, websites, or policies that are outside our control.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of laws rules.

If you are a consumer, mandatory consumer protection provisions of the country where you have your habitual residence remain unaffected.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated version and update the "Last updated" date.

Your continued use of the Service after the updated Terms take effect means you accept the revised Terms.
